•ouncil Member <br />introduced the following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 06 -73 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO ALLOW A DOG KENNEL AT <br />7933 24TH AVENUE <br />WHEREAS, Linda Ide has submitted a request to the City to grant a conditional use permit to allow for a dog <br />kennel at 7933 24th Avenue, and <br />WHEREAS, the legal description of the property is: <br />The South 926.80 feet of the east 470 feet of the northeast quarter of the northeast quarter of section 12 <br />township 31 range 22, excluding road and subject to easements of record. <br />and <br />WHEREAS, the City's review is based on the Plan Set received January 11, 2006; <br />WHEREAS, the Planning Commission held a public hearing on the application on April 12, 2006, and <br />recommended approval with conditions, and <br />"'WHEREAS, the City Council of the City of Lino Lakes fords that, with the conditions odditions of approval included in <br />this resolution, the following findings of fact apply as required by Section 2 Subd. 2.B.7 and by Section 8 <br />Subd.2.I.4 of the zoning ordinance: <br />a. This application is consistent with the comprehensive plan, including future and present land uses. The <br />building additions do not alter existing uses on the site. <br />b. The application meets all performance standards. <br />c. The project will not increase traffic generation or impacts. <br />d. The project will not increase demands on sanitary sewer and water use. <br />e. The project will not require capital improvements by the City. <br />f. The project will not create detrimental impacts. <br />g. The project will not impact natural or historic features. <br />h. All applicable Minnesota Pollution Control Agency requirements are satisfactorily met. <br />i. The project will not alter the site's drainage system previously approved by the City Engineer. <br />NOW, THEREFORE, BE IT RESOLVED, that the Lino Lakes City Council hereby approves an amendment of <br />the existing conditional use permit to allow the construction of the building addition depicted on the submitted <br />plans. <br />BE IT FURTHER RESOLVED that the following conditions apply: <br />1. The applicant must obtain a dog kennel license from the City of Lino Lakes. <br />2. Ongoing compliance with Sections 502, 503, and 607 of the City Code. <br />3. At no time shall dogs that are not owned by th 7 2rcupant of the dwelling be allowed to remain on the <br />property overnight. <br />
