• <br />• <br />• <br />LIQUOR VIOLATIONS HEARING <br />STAFF ORIGINATOR: Sgt. Bill Hammes <br />MEETING DATE: May 22, 2006 <br />TOPIC: Liquor Compliance Checks & Violations <br />BACKGROUND <br />The Police Department conducted liquor regulation compliance checks at all Lino <br />Lakes' liquor establishments. On February 24, 2006, the following three <br />establishments failed the compliance checks: <br />American Legion Post #566 <br />Circle -Lex VFW <br />Miller's on Main <br />Pursuant to city regulations, this hearing has been called to consider penalties for the <br />compliance violations. Each of the above noted license holders have received the <br />attached notice. The letter explains the purpose of the hearing and the process. At <br />this hearing, it is requested that the council determine whether these establishments <br />violated the Lino Lakes Code of Ordinances, Section 701 relating to Liquor Licensing <br />(attached) and what, if any, action should be taken. <br />Police Chief David Pecchia has reviewed this matter and directed staff to report with <br />an overview of the police department's findings at the hearing. The police department <br />is also including a Best Practices Grid, the city's adopted guide for consideration of <br />penalties. <br />RECOMMENDATION <br />The three establishments mentioned above fall into the same category on the Best <br />Practices Grid. Therefore, if the council determines individually that Miller's on Main, <br />the American Legion, and the VFW have violated the Lino Lakes City Code, Section <br />701, staff would recommend imposing the following penalties for each. <br />1. $500 financial penalty <br />2. Require all employees who serve alcohol to attend server training. <br />3. Mandatory liquor code handbook to be available to all employees at all <br />times. <br />ATTACHMENTS <br />1.
