Minnesota <br />Pollution <br />Control <br />Agency <br />Municipal <br />Division <br />(A) k <br />New MS4 General Permit: <br />Overview of Changes <br />General NPDES /SDS Permit MNR040000 for <br />Municipal Separate Storm Sewer Systems (MS4s) <br />Effective June 1, 2006 <br />Municipal Division, wq- strm4 -56, March 2006 <br />Introduction <br />This fact sheet provides an overview of <br />the changes that have been made to the <br />MS4 General Permit since it was first <br />issued in March 2003. <br />Why was the permit revised <br />before it expired? <br />The permit has been revised to meet the <br />requirements of a May 2003 Minnesota <br />Court of Appeals decision in which the <br />court required the MPCA to provide <br />opportunity for public review of the <br />Storm Water Pollution Prevention <br />Programs (SWPPP), and address <br />nondegradation for all waters. The <br />permit now includes new public notice <br />requirements and new Appendices D and <br />E which contain nondegradation <br />requirements for Selected MS4s. <br />Do I need to submit a new <br />SWPPP? <br />Your existing SWPPP may be modified <br />to incorporate previous comments from <br />the MPCA. You may need to revise your <br />SWPPP to meet any new applicable <br />requirements of the permit, especially <br />Appendices C, D, and E. <br />What are the main changes to the <br />permit? <br />Limitations on coverage <br />The permit no longer specifies new or <br />expanded discharges for all limitations <br />on coverage, unless the requirements of <br />Appendix C are met. The terms new or <br />expanded as used in the permit are <br />limited to specific activities that are <br />regulated in rule or in the previous <br />permit. <br />The permit now also includes <br />requirements for discharges affecting <br />Source Water Protection Areas. <br />Public notice requirements <br />Applicants who submit a complete <br />application that meets permit <br />requirements are not extended coverage <br />under the new permit until the SWPPP is <br />public noticed and approved by the <br />MPCA. The MPCA will provide public <br />notice for the individual SWPPPs. <br />Permit application deadlines <br />Owners and operators of regulated small <br />MS4s must apply for permit coverage by <br />June 1, 2006. The 43 MS4s designated <br />for coverage under Minn. R. ch. 7090 <br />are required to obtain permit coverage <br />by February 15, 2007. A list of MS4s is <br />available on the MPCA Web site at: <br />www.pca.state.mn.us/water/stormwater <br />/stormwater- ms4.html <br />SWPPP implementation <br />SWPPP implementation dates have <br />changed. Full implementation of the <br />SWPPP must be completed by June 30, <br />2010.
