WS -4 <br />WORK SESSION MEMORANDUM <br />To: City Council <br />From: Michael Grochala <br />Date: June 5, 2006 <br />Re: Work Session Item 4 <br />I -35W /Lake Drive Improvement Project <br />PROJECT STATUS <br />Staff is currently working with SEH, Inc. to complete the final design on the <br />interchange project. Right of way acquisition will commence within the next two <br />months. Approximately 18 parcels bordering the project may be affected. The <br />majority of acquisitions involve, for the most part, a strip acquisition parallel with <br />Lake Drive. Two parcel may need to be acquired in their entirety. In addition to <br />road right -of -way, there will be a need to acquire both drainage and utility <br />easements, as well as trail easements over portions of the project area. <br />Temporary easements will also be required to allow for the new construction to <br />match into existing conditions. <br />Once the limits of right -of -way is confirmed the acquisition process will <br />commence. SEH Inc., is preparing a Right -of -Way plat that will identify each <br />parcel proposed for acquisition. We are anticipating that this will be brought to <br />the council for consideration in early July. Appraisals will be completed and /or <br />updated on each parcel and reviewed with the property owner. Staff is working <br />with Dan Wilson of Wilson Development Services on the property acquisition. <br />We are attempting to make offers on all the properties by mid July. Our primary <br />goal is to acquire all the properties by direct purchase. However, if we cannot <br />reach a settlement with all parties it may be necessary to commence eminent <br />domain proceedings. Such proceedings cannot be initiated until 60 days have <br />elapsed from the date of the original offer. <br />It is important to note, in light of the recent media coverage and state legislation <br />regarding eminent domain, that the parcel acquisition is for a public purpose to <br />improve safety and mobility along Lake Drive. Additionally, the City needs to <br />have possession of the necessary right -of -way and easements before County <br />1 <br />
