• <br />• <br />• <br />Council Member <br />adoption: <br />introduced the following resolution and moved its <br />CITY OF LINO LAKES <br />RESOLUTION NO. 06 -53 <br />RESOLUTION DENYING A CONDITIONAL USE PERMIT FOR AN <br />ACCESSORY DRIVE THROUGH FACILITY AND <br />RESTAURANT OUTDOOR DINING FACILITIES <br />FOR MILLERS CROSSROADS SHOPPING CENTER <br />WHEREAS, The Millers Crossroads development was approved in 2003 with Resolution <br />03 -142 including one commercial lot at the corner of Birch St. and Hodgson Rd., and; <br />WHEREAS, the legal description of the property is <br />Lot 16, Block 1, Millers Crossroads according to the plat of record <br />thereof, Anoka County, Minnesota <br />and; <br />WHEREAS, an accessory drive through facility and outdoor dining facilities are <br />proposed on the site, both of which require a conditional use permit, as stated in <br />the zoning ordinance; and <br />WHEREAS, the City Council makes the following findings: <br />1. The 2003 consideration and approval of the Millers Crossroads plat included a single <br />driveway to the commercial lot. The City Council discussion included concern about <br />the possibility of a drive through, but the single driveway was not conducive to a <br />drive through facility. <br />2. <br />The zoning ordinance includes standards for all conditional use permits, listed in <br />Section 2, Subdivision 2.B.7. Subdivision 2.B.7.a requires that the proposed <br />development application must be consistent with the policies and recommendations of <br />the Lino Lakes Comprehensive Plan including: <br />1) Land Use Plan. <br />2) Transportation Plan. <br />3) Utility (Sewer and Water) Plans. <br />4) Local Water Management Plan. <br />5) Capital Improvement Plan. <br />6) Policy Plan. <br />7) Natural Environment Plan. <br />
