MEETING DATE: August 14, 2006 <br />TOPIC: Resolution 06 -53 <br />Conditional Use Permit <br />- Accessory Drive Through Facility and <br />- Restaurant Outdoor Dining Facilities <br />Millers Crossroads Shopping Center <br />BACKGROUND <br />The Millers Crossroads development was approved in 2003 with Resolution 03 -142. The <br />project includes one commercial lot at the corner of Birch St. and Hodgson Rd. This lot <br />received approval for a conditional use permit for a daycare business that would have <br />filled part of a commercial building. That business did not materialize and the building <br />was never constructed. <br />The 2006 proposal includes a coffee shop in the east end of the building and a fast food <br />sandwich shop in the west end. The remaining space is unassigned, but the anticipated <br />use is medical offices. The applicant has requested a conditional use permit for an <br />accessory drive through and outdoor seating, both for the coffee shop. Each of these is a <br />conditional use, and we have combined them into one conditional use permit. If the drive <br />through and outdoor seating facilities were not requested, the project would be reviewed <br />administratively. Discussion of the building is included here for informational purposes. <br />The proposed building is very similar to what was approved in 2003, but with some <br />improvements in materials. <br />This layout being considered now, received in July, is a revision of the plan submitted in <br />December 2005 and reviewed through 2006. The current plan does not include an <br />additional driveway to serve the drive through facility. On the July 2006 plan, vehicles <br />would enter the site via the driveway approved in 2003, drive around the building, and <br />exit via the same driveway. This required some alteration of the layout, including a drive <br />land on the west side of the building. <br />The applicant agreed at the June 12 city council meeting to extend the review period. <br />The city council must make a decision at this August 14 meeting. The current deadline is <br />August 16. <br />
