• <br />• <br />AGENDA ITEM 1 D <br />STAFF ORIGINATOR: Julie Bartell, City Clerk <br />MEETING DATE: October 9, 2006 <br />TOPIC: Consider Approving Application for Exempt <br />Permit for Lawful Gambling License, Anoka <br />County Pheasants Forever <br />VOTE REQUIRED: Simple Majority (3/5 Vote) <br />BACKGROUND: <br />The organization, Anoka County Pheasants Forever, has applied for an exempt <br />permit to conduct a raffle on February 4, 2007. Non - profit organizations are <br />allowed, under the State Gambling Statutes, to apply for an exemption from a <br />gambling license if they conduct fewer than five (5) gambling occasions per <br />calendar year. Anoka County Pheasants Forever conducts fewer than five (5) <br />per calendar and, therefore, remains exempt from requiring a gambling license. <br />Minnesota Statute, Chapter 349, Section 349.166, Subd. 2 does, however, <br />require that the non - profit organizations applying for the exemption permit notify <br />the city that they are applying for the exemption. A copy of the application for <br />this event is on file in the city clerk's office, along with proof of non - profit status. <br />The police department has conducted a background investigation on the CEO of <br />the organization and has reported no reason to deny this permission. <br />OPTIONS: <br />1. Adopt a motion approving the application for an exempt permit for <br />Anoka County Pheasants Forever raffle on February 4, 2007. <br />2. Deny the application for exemption. <br />RECOMMENDATION: <br />Option No. 1 <br />-22- <br />
