• <br />• <br />STAFF ORIGINATOR: <br />CITY COUNCIL <br />MEETING DATE: <br />TOPIC: <br />AGENDA ITEM 6E <br />Michael Grochala, <br />October 9, 2006 <br />Consideration of Resolution No. 06 -161, Approving <br />Request for Payment from Municipal Turnback <br />Account (Former Trunk Highway 49) <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND: <br />In 1996 the City Council entered into an agreement with the State of Minnesota <br />providing for a portion of Trunk Highway 49 to be turned back to the City. <br />Approximately .28 miles of the roadway (4th Avenue from Lilac to the entrance of the <br />Minnesota Correctional Facility) was transferred to City jurisdiction. The roadway is <br />now part of the City's Municipal State Aid System (MSAS). <br />Under State requirements the City is eligible to receive state aid reimbursement for <br />reconstruction of the roadway or accept a lump sum payment. Eligibility for Turn Back <br />proceeds terminates within 15 years of the local jurisdictions acceptance of the <br />roadway. This segment of 4th Avenue is listed within the "Good" Category (Highest <br />Category) of the City's Pavement Management Program. Based on the roadway <br />condition rating there is no need to reconstruct 4th Avenue within the next five years. <br />The City is currently eligible to receive a lump sum payment in the amount of <br />$955,404.00. Funds provided by the payment originate from the Minnesota Highway <br />Users Tax Distribution Fund. These funds are for use by the City on the state aid <br />system. The City has several higher priority State Aid street needs, including the <br />35W /Lake Drive Interchange, where these funds can be used. 4th Avenue will remain <br />on the City's State Aid System and is still eligible for funding from the City's State Aid <br />account in future years. <br />RECOMMENDATION: <br />Staff recommends adoption of Resolution No. 06 -161 Approving request for payment <br />from the Municipal Turnback Account. <br />ATTACHMENTS <br />1.
