• <br />• <br />AGENDA ITEM 1 F <br />STAFF ORIGINATOR: Julie Bartell, City Clerk <br />MEETING DATE: October 23, 2006 <br />TOPIC: Consider Approving Application for Exempt <br />Permit, St. Joseph Catholic Church <br />VOTE REQUIRED: Simple Majority (3/5 Vote) <br />BACKGROUND: <br />St. Joseph Catholic Church has applied for an exempt permit to conduct a raffle <br />at their annual Venison Feed to be held on November 28, 2006. The proceeds <br />from this fundraising event will be used to award college scholarships to <br />members of St. Joseph Catholic Church high school seniors. Non - profit <br />organizations are allowed, under the State Gambling Statutes, to apply for an <br />exemption from a gambling license if they conduct fewer than five (5) gambling <br />occasions per calendar year. St. Joseph Catholic Church conducts fewer than <br />five (5) gambling events per calendar and, therefore, remains exempt from <br />requiring a gambling license. <br />Minnesota Statutes, Chapter 349, Section 349.166, Subd. 2 does, however, <br />require that the non - profit organizations applying for the exemption permit notify <br />the city that they are applying for the exemption and city policy requires a <br />background investigation each time a permit or license application is received. <br />The Lino Lakes Police Department conducted an investigation of the applicant <br />and found no reason to deny the application. <br />The city is allowed to request a 30 day waiting period as part of its approval. <br />However, given the schedule for this event and the requirement to get the permit <br />to the state for review, staff requests that the council approve the request with no <br />waiting period. <br />A copy of the application is on file in the city clerk's office. <br />OPTIONS: <br />1. Approve the application with no waiting period <br />2. Deny the application <br />RECOMMENDATION: <br />Option No. 1 <br />
