• <br />• <br />STAFF ORIGINATOR: <br />MEETING DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />BACKGROUND: <br />AGENDA ITEM 1G <br />Julie Bartell, City Clerk <br />October 23, 2004 <br />Consider Approving Application for Exempt <br />Permit from Lawful Gambling License (Bingo), St. <br />Joseph Catholic Church <br />Simple Majority (3/5 Vote) <br />St. Joseph Catholic Church has applied for an exempt permit to conduct its annual <br />"Turkey Bingo" event which helps fund Thanksgiving food baskets. The event is <br />scheduled for November 19, 2006. Non - profit organizations are allowed, under the <br />State Gambling Statutes, to apply for an exemption from a gambling license if they <br />conduct fewer than five (5) gambling occasions per calendar year. St. Joseph Catholic <br />Church conducts fewer than five (5) per calendar and, therefore, remains exempt from <br />requiring a gambling license. <br />Minnesota Statutes, Chapter 349, Section 349.166, Subd. 2 does, however, require that <br />the non - profit organizations applying for the exemption permit notify the city that they <br />are applying for the exemption and city policy requires a background investigation each <br />time a permit or license application is received. The Lino Lakes Police Department <br />conducted an investigation of the applicant and found no reason to deny the application. <br />The city is allowed to request a 30 day waiting period as part of its approval. However, <br />given the schedule for this event and the requirement to get the permit to the state for <br />review, staff requests that the council approve the request with no waiting period. <br />The application is on file in City Clerk's office. <br />OPTIONS: <br />1. Adopt a motion approving the application for exemption with no waiting period <br />2. Deny the application for exemption. <br />RECOMMENDATION: <br />• Option No. 1 <br />
