Since that time the Legacy <br />Townhomes PUD final plan was approved and minor deviations from the original ponding <br />layout have caused the need to alter the layout of the ponding. The applicant will dedicate new <br />drainage and utility easements in conjunction with the Final Plat of the site which will follow the <br />second reading of this request on the November 27th agenda. <br />ANALYSIS <br />For clarification purposes staff has recommended to the applicant to vacate the existing <br />easements and with the final plat for the Legacy Townhomes 2nd Addition, a blanket drainage <br />and utility easement will cover the entire `outlot' area surrounding the lots of the townhome <br />units. <br />RECOMMENDATION <br />Staff recommends approval of this request. <br />ATTACHMENTS <br />• Ordinance No. 13 -06 <br />
