• <br />• <br />• <br />Council Member <br />Legacy Townhomes 2nd Vacation, page 2 <br />moved for adoption of the following ordinance: <br />CITY OF LINO LAKES <br />ORDINANCE NO. 13-06 <br />AN ORDINANCE VACATING DRAINAGE AND UTILITY EASEMENTS FROM <br />OUTLOT B THE VILLAGE NO. 3 PLAT (LEGACY TOWNHOMES 2ND ADDITION). <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />Section 1 Findings <br />The City Council makes the following findings regarding the application to vacate a portion of <br />public right -of -way and existing street and utility easements: <br />1. The Hartford Group, Inc., the owners of property adjacent to Lois Lane legally described as <br />Outlot B The Village No. 3 has requested the City Council to vacate an the drainage and <br />utility easements as recorded on the Village No. 3 plat according to law. <br />2. A public hearing was held on November 13, 2006 before the City Council in the city hall on <br />such request after due published and posted notice had been given, as well as personal notice <br />to affected property owners by the clerk on October 23, 2006 and all persons interested were <br />given an opportunity to be heard; <br />3. The applicant is dedicating to the public, as part of the Final Plat for Legacy Townhomes 2nd <br />Addition all necessary drainage and utility easements; <br />4. It appears that it will be in the best interest of the city to approve such request <br />Section 2 <br />Such request is hereby granted and that the Drainage and Utility Easement platted on Outlot B of <br />The Village No.3 described as follows are hereby vacated: <br />Those Drainage and Utility easements dedicated in the plat of THE VILLAGE NO.3, <br />Anoka County, Minnesota, which lie within Outlot B said THE VILLAGE NO. 3. <br />Section 3 <br />That any person, corporation or city owning or controlling easements contained upon the <br />property vacated reserves the right to continue maintaining the same or to enter upon such way <br />or portion thereof vacated to maintain, repair, replace, remove or otherwise attend thereto. <br />Section 4 <br />This ordinance shall be in force and effect upon its adoption and publication and in accordance <br />with the Lino Lakes City Charter. <br />Attest: Julianne Bartell, City Clerk <br />John Bergeson, Mayor <br />
