• • • Council Member Legacy Townhomes 2nd Vacation, page 2 moved for adoption of the following ordinance: CITY OF LINO LAKES ORDINANCE NO. 13-06 AN ORDINANCE VACATING DRAINAGE AND UTILITY EASEMENTS FROM OUTLOT B THE VILLAGE NO. 3 PLAT (LEGACY TOWNHOMES 2ND ADDITION). The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: Section 1 Findings The City Council makes the following findings regarding the application to vacate a portion of public right -of -way and existing street and utility easements: 1. The Hartford Group, Inc., the owners of property adjacent to Lois Lane legally described as Outlot B The Village No. 3 has requested the City Council to vacate an the drainage and utility easements as recorded on the Village No. 3 plat according to law. 2. A public hearing was held on November 13, 2006 before the City Council in the city hall on such request after due published and posted notice had been given, as well as personal notice to affected property owners by the clerk on October 23, 2006 and all persons interested were given an opportunity to be heard; 3. The applicant is dedicating to the public, as part of the Final Plat for Legacy Townhomes 2nd Addition all necessary drainage and utility easements; 4. It appears that it will be in the best interest of the city to approve such request Section 2 Such request is hereby granted and that the Drainage and Utility Easement platted on Outlot B of The Village No.3 described as follows are hereby vacated: Those Drainage and Utility easements dedicated in the plat of THE VILLAGE NO.3, Anoka County, Minnesota, which lie within Outlot B said THE VILLAGE NO. 3. Section 3 That any person, corporation or city owning or controlling easements contained upon the property vacated reserves the right to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove or otherwise attend thereto.
