• <br />AGENDA ITEM 6.A. <br />STAFF ORIGINATOR: Paul Bengtson <br />CC MEETING DATE: February 11, 2008 <br />TOPIC: 2nd Reading of Ordinance 17 -07 <br />Vacating a portion of the drainage and utility easement on <br />Lot 16 Block 4 of the recorded plat Park Grove <br />VOTE REQUIRED: 4/5 <br />BACKGROUND <br />Stephen & Jacklyn Tlachac have requested that the City Council vacate a portion of the drainage <br />and utility easement on Lot 16 Block 4 of the recorded plat Park Grove. They are requesting that <br />the 30 foot easement along the south property line be reduced to allow them to make <br />improvements including a swimming pool and deck. <br />ANALYSIS <br />The easements as platted on the Park Grove plat included a thirty foot wide easement on the <br />south property line of this lot. The City Engineer has determined that only 15 feet of easement <br />area is necessary for the city to maintain the drainage patterns of the surrounding area in <br />perpetuity, and no documentation has been found to identify why the easement was platted at 30 <br />feet in width. <br />The City Engineer has visited the site and met with surrounding property owners in an attempt to <br />address their concerns about drainage in the area. As a result, it has been identified that there is a <br />drainage issue in the area that is completely separate from this vacation request. This issue will <br />be addressed within the 2008 surface water management project, and the necessary <br />improvements can easily be made and maintained with the reduced easement width. <br />RECOMMENDATION <br />Staff recommends approval of the 2nd Reading of this Ordinance. <br />ATTACHMENTS <br />1.
