Council Member moved for adoption of the following ordinance: <br />CITY OF LINO LAKES <br />ORDINANCE NO. 17 -07 <br />AN ORDINANCE VACATING A PORTION OF THE DRAINAGE AND UTILITY <br />EASEMENT ON LOT 16 BLOCK 4 OF THE RECORDED PLAT PARK GROVE. <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />Section 1 Findings <br />The City Council makes the following findings regarding the application to vacate a permanent <br />roadway easement: <br />1. Stephen & Jacklyn Tlachar, have requested that the City Council vacate a portion of the <br />drainage and utility easement on Lot 16 Block 4 of the recorded plat Park Grove. <br />2. A public hearing was held on January 14, 2008 before the City Council in the city hall on <br />such request after due published and posted notice had been given, as well as personal notice <br />to affected property owners by the clerk on October 25, 2007 and all persons interested were <br />given an opportunity to be heard; <br />3. It appears that it will be in the best interest of the city to approve such request <br />Section 2 <br />Such request is hereby granted and that drainage and utility easement described as follows are <br />hereby vacated: <br />The north 15 feet of the south 30 feet of Lot 16, Block 4, PARK GROVE, Anoka County, <br />Minnesota, except the east and west 5 feet of said Lot 16. <br />Section 3 <br />That any person, corporation or city owning or controlling easements contained upon the <br />property vacated reserves the right to continue maintaining the same or to enter upon such way <br />or portion thereof vacated to maintain, repair, replace, remove or otherwise attend thereto. <br />• <br />• <br />• <br />
