sought a recommendation from the Fire Chief (Fire Chief Bennett's <br />response to Mr. Wagner' s variance request is attached); <br />sought advice from the League of Minnesota Cities clarifying definitions <br />of the statutory criteria for the issuance of a fire code variance to ensure <br />that the Council preserves the liability protection provided in the statute <br />(i.e. "undue hardship" and "decisions made in good faith "). <br />(The Risk Management Attorney for the LMCIT will be providing the <br />requested clarification on Monday.) <br />REQUEST TO THE COUNCIL <br />Mr. Chad Wagner, owner of Millers' on Main, is requesting that the Council grant a <br />variance from the 20 foot minimum setback requirement from the north property line for <br />a tent structure for his summer tent event on Friday and Saturday, August 15 — 16, <br />2008. <br />OPTIONS FOR COUNCIL ACTION <br />The Council may: <br />1. approve the variance <br />2. deny the variance, or <br />3. modify the variance <br />If the council grants the requested variance, staff will initiate the process of reviewing <br />Mr. Wagner's request for a special event permit and cabaret permit in conjunction with <br />the same event. <br />ATTACHMENTS <br />1.
