• <br />• <br />AGENDA ITEM 6A <br />STAFF ORIGINATOR: Peter Kluegel <br />MEETING DATE: July 14, 2008 <br />TOPIC: Consider Resolution No. 08 -71, Ordering Removal of <br />Hazardous Structure, 745 Oak Lane <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND <br />Since November 15, 2005 the City of Lino Lakes has sent numerous letters to the <br />property owner at 745 Oak Lane to rectify several violations of the City Ordinances <br />which include: weed control, unlicensed vehicles, exterior storage, and attractive <br />building nuisance. Many complaints have been received from the neighbors regarding <br />the condition of the home and property. Efforts to gain compliance from the owner <br />have been uneventful. The condition of the property is such that the roof has <br />collapsed and is rotten, exposing the interior of the home to the elements and rodents; <br />portions of the home's walls have been crushed by trees; the floor and interior wall <br />sheathing is rotten and moldy; the foundation is cracked; and the home and detached <br />garage have broken windows, which may be an attractive nuisance to young children. <br />The home condition is beyond repair and is not habitable. The property is unoccupied. <br />RECOMMENDATION <br />Pursuant to Minnesota statute 463.15, this property constitutes a "hazardous building <br />or hazardous property" in that because of its inadequate maintenance, dilapidation, <br />physical damage, unsanitary condition and abandonment, it constitutes a fire hazard <br />and hazard to public safety and health. As a result, staff recommends that the City <br />Council order the immediate abatement and removal of this structure. <br />ATTACHMENTS <br />1. Resolution No. 08 -71 <br />
