Council Member introduced the following resolution and moved its <br />adoption <br />CITY OF LINO LAKES <br />RESOLUTION NO. 08 -71 <br />RESOLUTION ORDERING REMOVAL OF HAZARDOUS STRUCTURE <br />In the Matter of the Hazardous Building Located at <br />745 Oak Lane, Lino Lakes, Minnesota 55014 <br />and legally described as: <br />That part of the Southeast 1 Quarter of the Northeast Quarter of <br />sec 8, Township 31, Range 22, Anoka County, Minnesota, <br />described as follows: commencing at the Southeast corner of <br />said Southeast Quarter of Northeast Quarter; thence West <br />along the South line thereof a distance of 466.4 feet to the point <br />of beginning; thence continuing West along said South line 165 <br />feet; thence North 3 degrees 22 minutes East, 315.1 feet; <br />thence Easterly, 150 feet on line parallel to and 315 feet North <br />of the South line of said Southeast Quarter of Northeast <br />Quarter to an existing iron monument; thence Southerly, 315 <br />feet to the point of beginning. The above described tract of <br />land now being a part of lot 14, AUDITORS SUBDIVISION NO. <br />100. <br />WHEREAS, pursuant to Minn. Stat. § 463.15 to 463.261 the City Council of the <br />City of Lino Lakes having duly considered the matter finds the above <br />unoccupied building to be a hazardous building for the following reasons: <br />1) The roof has collapsed and is rotten, exposing the interior of the <br />home to the elements and rodents; <br />2) Portions of the home's walls have been crushed by trees; <br />3) The floor and interior wall sheathing is rotten and moldy; <br />4) The foundation is cracked; <br />5) The home and detached garage have broken windows, which may be <br />an attractive nuisance to young children; <br />6) The structure is unstable and is in danger of collapse, which could <br />cause injury and damage to persons and property adjacent thereto; <br />and <br />7) The home condition is beyond repair and is not habitable <br />and, <br />WHEREAS, the hazardous conditions set out herein have been observed and <br />confirmed by the City Building Official, Peter Kluegel, and documented in his <br />report to the Lino Lakes City Council, dated July 14, 2008; and <br />42 <br />• <br />• <br />• <br />
