• <br />• <br />• <br />WHEREAS, despite efforts to gain compliance from the owner, the owner has <br />refused to respond to the City's request to have the structure razed. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LINO LAKES, MINNESOTA, pursuant to the foregoing findings and in <br />accordance with Minn. Stat. §463.15 to 463.261, the Council hereby orders the <br />record owners of the above hazardous building, or their representatives, to raze <br />the hazardous building within 30 days of the date of the service of this order, <br />and <br />BE IT FURTHER RESOLVED, the Council further orders that no person shall <br />occupy or enter the building and that a "No Occupancy" sign be posted thereon, <br />and <br />BE IT FURTHER RESOLVED, the Council further orders that unless corrective <br />action is commenced or an answer served upon the City and filed in the Office <br />of District Court Administrator of Anoka County, Minnesota within 20 days from <br />the date of service of this order, a motion for the summary enforcement of this <br />order will be made to the District Court of Anoka County, and <br />BE IT FURTHER RESOLVED, the Council orders that if the City is compelled to <br />take any corrective action herein, all necessary costs expended by the City will <br />be assessed against the real estate concerned and collected in accordance <br />with Minn. Stat. § §463.21 and 463.22, and <br />BE IT FURTHER RESOLVED, the Mayor, Clerk, City Attorney and other <br />officers and employees of the City are authorized and directed to take such <br />action, prepare, sign and serve such papers as are necessary to comply with <br />this order and to assess the costs thereof against the real estate described <br />above for collection along with taxes. <br />John Bergeson, Mayor <br />ATTEST: <br />Julie Bartell, City Clerk <br />Adopted by the Lino Lakes City Council this day of , 2008. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member and upon vote being taken thereon, the following voted in <br />favor thereof: <br />The following voted against the same: <br />Whereupon said resolution was declared duly passed and adopted. <br />
