10-foot berm along the easterly boundary of the park activity area, but much of the area <br />remains above daytime noise standards. <br />Note: A 12 foot berm is being constructed along the easterly boundary of 'the park along <br />I-35E. <br />Staff consulted with the MPCA and MNDOT noise specialists and had the following <br />comments: <br />1. The Traffic Noise Assessment applied certain exceptions to the state rules which <br />brought those noise levels that exceeded standards into compliance; however, it is <br />the opinion of both MPCA and MNDOT those exceptions do not apply to this <br />project. Noise standards for nighttime levels along both I-35E and CSAH 54 <br />exceed the limits. <br />2. Field monitoring data shall be collected to support the traffic modeling data in the <br />study. <br />3. The developer/consultant shall provide a cost benefit analysis and documentation <br />for avoidance and mitigation efforts. Factors to be considered include increased <br />setbacks, higher berms and noise wall construction. <br />Whereas full compliance with noise standards is certainly a goal of the City, it may not <br />be achievable. The intent of noise mitigation is to minimize the effects of noise to the <br />greatest extent possible but within reasonable costs and measures. The developer is <br />installing berms and landscaping along CSAH 54 and in the park to minimize noise. The <br />developer shall provide a cost benefit analysis to determine if additional or alternative <br />noise mitigation techniques are feasible. <br />Floodplain <br />The 1982 FEMA Flood Insurance Rating Map (FIRM) indicates the southeast quadrant of <br />the site is located within a designated Zone A flood plain district. Per the Stormwater <br />Management Plan, the 100-year flood elevation is 909.7 which according the RCWD, <br />this would also be the 100-year regulatory flood elevation. <br />A Conditional Letter of Map Revision (CLOMR) shall be obtained from the Federal <br />Emergency Management Agency (FEMA) prior to issuance of any grading permits for <br />land located within the floodplain. A Letter of Map Revision (LOMR) shall be obtained <br />from FEMA prior to issuance of any building permits for lots located within the <br />floodplain. <br />Growth Management Policy <br />Per the Comprehensive Plan (page 3-27), an annual average of 230 units per year over <br />each 5 year phasing period not to exceed 345 units in any 1 year is allowed.
