10. Compliance with Laws <br />Sweeney, Borer & Sweeney agrees that during the term of any contractual relationship with the City of <br />Lino Lakes, the firm will comply with all applicable federal, State, and local equal opportunity and non- <br />discrimination laws and regulations. <br />C. ATTORNEY QUALIFICATIONS: <br />1. City Attorney - Civil <br />Sweeney, Borer & Sweeney proposes to provide civil legal services to the City of Lino Lakes as <br />follows. Patrick Sweeney would serve as the contact person relative to general legal services and <br />attend the majority of City Council meetings. Pat would coordinate the delivery of all legal services. <br />Pat Sweeney would also be the contact person relative to special projects, litigation, arbitration, <br />mediation, and specific development projects. Thomas Sweeney and George Borer would also <br />provide civil legal services as necessary. <br />Patrick J. Sweeney <br />Patrick J. Sweeney is licensed to practice law in the state and federal courts, and was admitted to the <br />Minnesota State Bar in 1990. He is currently a member of the Ramsey County and Minnesota State Bar <br />Associations. Pat is rated as an AV attorney in Martindale- Hubbell Legal Directory, which is the <br />highest rating of attorneys ranked by their peers in the United States. Pat's academic training includes <br />St. John's University (B.S., 1987) and William Mitchell College of Law (J.D., 1990). <br />Pat originally practiced law with the firm of 'Crass & Monroe, where he represented several municipal <br />clients and gained valuable knowledge about public sector legal services. He joined Sweeney, Borer & <br />Sweeney in 1991 and became a partner /shareholder in 1996. <br />Pat has experience in all aspects of municipal law, and specifically a broad litigation background. He <br />has tried numerous civil cases (both court and jury trials) to successful conclusions. These cases <br />involve special assessments, special assessment appeals, land use issues, conditional use permits, and <br />eminent domain cases. One of the special assessment cases was entitled "Marzitelli vs. City of Little <br />Canada ". The Minnesota Supreme Court upheld the City's argument that the appeal was untimely and <br />dismissed the appeal. Pat was recently successful in convincing the Ramsey County District Court to <br />issue a permanent injunction requiring a Little Canada property owner to comply with City Ordinances. <br />Pat was also recently able to successfully defend the City of Little Canada in a Temporary Restraining <br />Order action. Pat has been involved in extensive litigation relative to the exercise of eminent domain <br />in the Twin City Metropolitan area. <br />Pat recently concluded an eminent domain case in the City of Blaine relating to a frontage road west of <br />Highway 65. This case involved a five day trial in the Anoka County District Court from October 22 <br />through October 26, 2007. On October 29, 2007, the jury returned a verdict of $194,000.00, which was <br />over $1,000,000.00 less than the amount demanded by the property owner in the trial of this matter. <br />7 <br />
