COUNCIL MINUTES April 28, 2014 <br />APPROVED <br />91 Council Member Roeser moved to approve Resolution No. 14 -36 as presented. Council Member <br />92 Kusterman seconded the motion. Motion carried on a unanimous voice vote. <br />93 <br />94 6B — Talan Ridge: i) 1st Reading of Ordinance No. 05 -14 to Rezone Property from R, Rural to <br />95 R -1 Single Family Residential; ii) Resolution No. 14 -34 Approving Preliminary Plat — <br />96 <br />97 City Planner Larsen, using a projector, reviewed the proposed project: <br />98 3 lot subdivision <br />99 history of the property (original plat) <br />100 six lot subdivision was once proposed <br />101 density — the proposal fits into guidance for the land; <br />102 - rezoning is required, from rural to residential (she reviewed the criteria) <br />103 wetland delineation on the property is underway <br />104 all three properties will be connected to public utilities <br />105 - a public hearing was held at the Planning and Zoning Committee at which concerns arose <br />106 about drainage issues; the Committee took two meetings to review the plans and they were <br />107 approved <br />108 on the matter of stormwater drainage, the developer has attempted to address concerns and the <br />109 city engineer has reviewed plans <br />110 park land fees will be included <br />111 the final plat for the project will have to come back for review and approval <br />112 <br />113 Council Member Roeser confirmed that the project contractor will have to ensure work is done <br />114 correctly and according to plans. <br />115 <br />116 Mayor Reinert noted that the council has heard from neighbors to this project; they have some valid <br />117 concerns about water runoff. He asked staff to explain what recourse property owners will have if <br />118 problems do arise and he finds that there apparently isn't a limit on the time people have to get help <br />119 from the city with concerns. The city will hear issues if they arise in the future. <br />120 <br />121 Council Member Roeser explained that it is the council's responsibility to honor plans that come <br />122 forward that meet city requirements and follow the guidance of the city's comprehensive plan. The <br />123 City planner confirmed that statement. Council Member Roeser added that it is also the city's <br />124 responsibility to see to it that the project is done right. <br />125 <br />126 Judith Brunner, 270 Linda Avenue, said she lives in the property to the south of this development. <br />127 Looking at the drainage plans, she is afraid that water will not flow as predicted and will come to her <br />128 house. City Engineer Wedel explained that while there are not defined ditches and curb and gutters <br />129 in that area, the water will flow as the plans and elevations indicate. If ditches are added, it will <br />130 require the removal of a significant number of trees in the area. <br />131 <br />132 The Mayor asked the City Engineer if there is any area that will get worse as a result of this <br />133 development. Mr. Wedel responded that the city is required to review the site plans which he has <br />134 done and he can report that the plans indicated the amount of run off is decreasing with the addition <br />135 of a new storm water pond. <br />3 <br />
