City of Lino Lakes, Minnesota <br />Management Report, Page 40 <br />Subd. 11. When a commissioner of any public housing or port <br />authority is employed by a bank engaged in making loans or per- <br />forming trust services involving real or personal property affected <br />by any plan or such housing or port authority, as restriction shall <br />apply to any such loans made or trust services performed by said <br />bank if the commissioner shall disclose the nature of such loans or <br />trust services of which he has personal knowledge, which disclosure <br />shall be entered upon the minutes of such authority. <br />471.881 EXCEPTIONS; APPLICATION <br />The exceptions provided in section 471.88 shall apply not- <br />withstanding the provisions of any other statute or city charter. <br />471.89 CONTRACT, WHEN VOID <br />Subd. 1. Procedure followed. A contract made pursuant to sec- <br />tion 471.88, subdivision 5, is void unless the procedure prescribed <br />by subdivision 2 and 3 is followed. <br />Subd. 2. Resolution by governing body. Except in an emergency <br />making such procedure impracticable, the governing body of the <br />governmental unit shall authorize the contract in advance of its <br />performance by adopting a resolution setting out the essential <br />facts and determining that the contract price is as low as or lower <br />than the price at which the commodity or services could be obtained <br />elsewhere. In case of an emergency when the contract cannot be <br />authorized in advance, payment of the claims shall be authorized by <br />a like resolution in which the facts of the emergency are also <br />stated. <br />Subd. 3. Claims, affidavits filed. Before such a claim is <br />paid, the interested officer shall file with the clerk of the <br />governing body an affidavit stating: <br />(a) The name of the officer and the office held by him; <br />(b) An itemization of the commodity or services furnished; <br />(c) The contract price; <br />(d) The reasonable value; <br />(e) The interest of the officer in the contract; and <br />(f) That to the best of his knowledge and belief the contract <br />price is as low as, or lower than, the price at which the <br />commodity or services could be obtained from other <br />sources. <br />Official guidelines are not yet published. We recommend, however, that the City <br />take steps to provide evidence of compliance in the public officials conflict of <br />interest area. To provide evidence, we recommend that a letter of representation be <br />received from all public officials stating that he /she has read the applicable statutes <br />and that no such conflicts exist (or that such conflicts be disclosed). We are <br />available to assist the City in this procedure. <br />
