40 <br />(f) All fees, charges, and escrow related to the preliminary or final plat shall be paid in full. <br />(3) (a) —The City Council shall act on the fmal plat by metienresolution. <br />(b4) The motion resolution shall include findings of fact supporting the approval or denial and shall be <br />entered in the proceedings of the City Council. <br />(e5) The lack of a simple majority Council vote to affirmatively approve the final plat shall be a denial <br />of the requested application. <br />(6) The City Council shall take action on the application for a final plat within 60 days following <br />submittal of an application completed in accordance with the regulations of this chapter if the applicant <br />has complied with all conditions and requirements of applicable regulations and all conditions and <br />requirements upon which the preliminary approval is expressly conditioned either through <br />performance or the execution of appropriate agreements assuring performance. This period may be <br />extended if an extension is agreed to by the applicant. <br />(1) Sanitary sewer, water, and streets shall only be installed in the area included in the approved final <br />plat. No construction/installation of sanitary sewer or water facilities or streets shall be allowed until <br />approval of a final plat, and approval of a development agreement for the sewer, water, and streets, and <br />recording of the agreement. <br />(Ord. 01 03, passed 2 21 2003) <br />§ 1001.058 FORM AND CONTENT. <br />The final plat shall be of the form and content as prescribed in the Minnesota Land Surveyors <br />Association Plat Manual of Minnesota Guidelines, as may be amended, and by state statute. <br />(Ord. 04 -03, passed 2 -24 -2003) <br />§ 1001.059 RECORDING. <br />(1) After approval of the fmal plat by the City Council, the developer shall submit 3 mylar copies of <br />the final plat and 1 electronic copy in a format compatible with the city's computer system. <br />(2) After approval and execution of the development contract, the contract shall be recorded. <br />(3) The developer shall record the plat within 90 days after the date of approval, otherwise the <br />approval of the final plat shall be considered void, unless the developer requests and receives an extension <br />from the City Council. <br />(Ord. 04 -03, passed 2 -24 -2003) <br />DRAFT JANUARY 26, 2009 <br />• <br />• <br />
