• <br />• <br />• <br />Anoka County Contract No. 2009 -, <br />JOINT POWERS AGREEMENT <br />FOR THE CONSTRUCTION OF IMPROVEMENTS TO <br />AND EXTENSION OF THE <br />RICE CREEK NORTH REGIONAL TRAIL <br />This agreement is made and entered into this day of , 2009, by and <br />between the County of Anoka, a political subdivision of the State of Minnesota, 2100 Third <br />Avenue, Anoka, Minnesota, 55303 ("County") and the City of Lino Lakes, a municipal <br />corporation under the laws of the State of Minnesota, 600 Town Center Parkway, Lino Lakes, <br />Minnesota, 55014 ("City "). <br />WITNESSETH: <br />WHEREAS, the County and the City desire to extend and construct certain <br />improvements to the Rice Creek North Regional Trail; and <br />WHEREAS, the improvements include the extension of the Rice Creek North Regional <br />Trail from the YMCA Community Center in Lino Lakes south through the Rice Creek Chain of <br />Lakes Park Reserve and the Chomonix Golf Course to Rice Lake Elementary School ('Trail <br />Extension "); and <br />WHEREAS, the improvements also include upgrades to existing trails, including the trail <br />through the Rice Creek Elementary School property, the existing County trail along Birch Street <br />to Ware Road; the existing City of Lino Lakes trail on the east side of Ware Road from Birch <br />Street south to Ash Street and the existing City of Shoreview trail that goes west along County <br />Road J from Ware Road to Lexington Avenue ('Trail Upgrades ") (hereinafter Trail Extension <br />and Trail Upgrades are collectively referred to as "Trail Improvements "); and <br />WHEREAS, the location of the Trail Improvements are depicted in the attached Exhibit <br />A; and <br />WHEREAS, pursuant to the terms and conditions contained herein the County and the <br />City have agreed to construct the Trail Improvements; <br />WHEREAS, Minn. Stat. § 471.59 authorizes political subdivisions of the State of <br />Minnesota to enter into joint powers agreements for the joint exercise of powers common to <br />each. <br />NOW, THEREFORE, it is mutually stipulated and agreed to as follows: <br />1. PURPOSE <br />The parties to this agreement have joined together for the purpose of causing the <br />construction of the Trail Improvements. <br />2_ METHOD <br />A. The County shall provide all engineering services and shall cause the <br />preparation of plans and specifications for the construction of the Trail <br />Improvements. <br />—22— <br />
