COUNCIL MINUTES October 12, 2009 <br />DRAFT <br />136 ii. Consideration of Resolution No. 09 -84, Adopting Assessments, 2009 Individual <br />137 Properties Which Requested Connection to City Utilities <br />138 <br />139 City Engineer Studenski reported that the council is being requested to approve a list of <br />140 assessments to individuals properties that have requested connection to city utilities. The <br />141 properties are noted in the staff report. <br />142 <br />143 Council Member O'Donnell moved to approve Resolution No. 09 -84 as presented. Council <br />144 Member Stoltz seconded the motion. Motion carried. <br />145 <br />146 6D. Consideration of Resolution No. 09 -89, Approving a Performance Agreement for <br />147 North Springs Church <br />148 <br />149 City Engineer Studenski explained that a church has purchased the now vacant former VFW <br />150 building at 7668 Lake Drive and they are proposing to complete the site and occupy the facility. <br />151 Staff has prepared a performance agreement that establishes and provides for certain conditions <br />152 appropriate to the plans and ensures completion of the work that was not done by the VFW. The <br />153 church will be submitting a letter of credit as well as the required escrow funds. Mr. Studenski <br />154 added that the church representatives are working with staff on a conditional use permit and <br />155 expect that will be presented for council consideration at the next regular meeting. He noted <br />156 that representatives of the church were present for any council questions. <br />157 <br />158 Several members of the council congratulated the church representatives on their plans to <br />159 occupy the facility. <br />160 <br />161 Council Member Reinert moved to approve Resolution No. 09 -89 as presented. Council <br />162 Member Stoltz seconded the motion. Motion carried.
