• Pinnacle Tower May 3, 2001 Page 4 1 Such antennas shall be considered an allowed conditional use within the PSP, Public and Semi Public District and shall be subject to the regulations and requirements of Section 2, Subdivision 2 (Administration: Conditional Use Permits). 2. The antennas, transmitting towers, or array of towers shall be located on a continuous parcel having a setback equal to the height of the antenna, transmitting tower, or array of towers measured between the base of the antenna or tower located nearest a property line and said property line, unless a qualified structural engineer specifies in writing that the collapse of any antenna or tower will occur within a lesser distance under all foreseeable circumstances. 3. Unless the antenna is mounted on an existing structure, at the discretion of the City, a fence not greater than eight (8) feet in height with a maximum opacity of fifty (50) percent shall be provided around the support structure and other equipment. 4. Towers in excess of one hundred fifty (150) feet may be of lattice design. 5. When applicable, proposals to erect new antenna towers shall be accompanied by any required federal, state, or local agency licenses. 6. Antenna towers shall not be artificially illuminated unless required by law or by the • Federal Aviation Administration (FAA) to protect the public's health and safety. 7 New towers shall be designed to accommodate the possibility of co- locating other users. OPTIONS 1. Recommend denial of a zoning text amendment to permit television and radio broadcasting towers in excess of 200 feet as a conditional use within the PSP, Public Semi Public District and a rezoning of the property located at 870 Birch Street from R, Rural District to PSP, Public and Semi Public District based on findings of fact from the Planning Commission. This would allow the existing tower to remain as a legal, non - conforming use. 2. Recommend approval of a zoning text amendment to permit television and radio broadcasting towers in excess of 200 feet as a conditional use within the PSP, Public Semi Public District and a rezoning of the property located 870 Birch Street from R, Rural District to PSP, Public and Semi Public District based on the findings outlined in the May 3, 2001 planning report and subject to the conditions outlined by staff. 3.
