• <br />Pinnacle Tower <br />May 3, 2001 <br />Page 4 <br />1 Such antennas shall be considered an allowed conditional use within the PSP, <br />Public and Semi Public District and shall be subject to the regulations and <br />requirements of Section 2, Subdivision 2 (Administration: Conditional Use Permits). <br />2. The antennas, transmitting towers, or array of towers shall be located on a <br />continuous parcel having a setback equal to the height of the antenna, transmitting <br />tower, or array of towers measured between the base of the antenna or tower <br />located nearest a property line and said property line, unless a qualified structural <br />engineer specifies in writing that the collapse of any antenna or tower will occur <br />within a lesser distance under all foreseeable circumstances. <br />3. Unless the antenna is mounted on an existing structure, at the discretion of the City, <br />a fence not greater than eight (8) feet in height with a maximum opacity of fifty (50) <br />percent shall be provided around the support structure and other equipment. <br />4. Towers in excess of one hundred fifty (150) feet may be of lattice design. <br />5. When applicable, proposals to erect new antenna towers shall be accompanied by <br />any required federal, state, or local agency licenses. <br />6. Antenna towers shall not be artificially illuminated unless required by law or by the <br />• Federal Aviation Administration (FAA) to protect the public's health and safety. <br />7 New towers shall be designed to accommodate the possibility of co- locating other <br />users. <br />OPTIONS <br />1. Recommend denial of a zoning text amendment to permit television and radio <br />broadcasting towers in excess of 200 feet as a conditional use within the PSP, <br />Public Semi Public District and a rezoning of the property located at 870 Birch <br />Street from R, Rural District to PSP, Public and Semi Public District based on <br />findings of fact from the Planning Commission. This would allow the existing tower <br />to remain as a legal, non - conforming use. <br />2. Recommend approval of a zoning text amendment to permit television and radio <br />broadcasting towers in excess of 200 feet as a conditional use within the PSP, <br />Public Semi Public District and a rezoning of the property located 870 Birch Street <br />from R, Rural District to PSP, Public and Semi Public District based on the findings <br />outlined in the May 3, 2001 planning report and subject to the conditions outlined <br />by staff. <br />3.
