Planning & Zoning Board <br />November 13, 2002 <br />Page 6 <br />Staff noted the primary issues of the CEPTED review regard traffic flow through the <br />development. The development has been redesigned to address these issues. <br />Staff indicated the Environmental Board reviewed the request at their October 30, 2002 <br />meeting and recommended approval. Their comments are attached to this report. <br />Staff noted is that the Board's recommendations related to lighting and landscaping has <br />been included as conditions of site and building plan/conditional use permit approval. <br />Staff stated the Rice Creek Watershed District (RCWD) has determined that the proposed <br />development will not require a Watershed District Permit as the impervious surface <br />coverage on the property does not exceed one acre. <br />Staff noted prior to the commencement of any site work, the applicant will be required to <br />enter into a development agreement with the City and post all the necessary securities <br />required by it. <br />Staff stated as previously indicated, the applicant is requesting approval of a conditional <br />use permit to allow a carwash within an I -1, Light Industrial zoning District (both drive - <br />through and self - service carwashes are listed as conditional uses). <br />Staff stated in considering conditional use permit requests, the Ordinance states that the <br />Planning and Zoning Board shall recommend approval and the City Council shall order <br />the issuance of such permit only if it finds that such use at such location: <br />1. Will not be detrimental to or endanger the public health, safety, comfort, convenience <br />or general welfare of the neighborhood or the City. <br />Comment: The proposed use is not anticipated to be detrimental or endanger the public. <br />2. Will be harmonious with the general and applicable specific plans and policies of the <br />comprehensive plan of the City and this ordinance. <br />Comment: The Comprehensive Plan suggests industrial use of the site. Within the <br />applicable LI, Light Industrial zoning district, carwashes are considered a conditional use. <br />Thus, the proposed land use satisfies the land use directives of the Plan. <br />3. Will be designed, constructed, operated, and maintained so as to be harmonious and <br />appropriate in appearance with the existing and/or intended character of the general <br />vicinity and will not change the essential character of that area. <br />Comment: The building design is consistent with material requirements of the Ordinance <br />and therefore will not negatively affect the essential character of the area. The proposed <br />building is in fact anticipated to improve the appearance of the area. <br />4. Will be served adequately by essential public facilities and services, including street, <br />police and fire protection, drainage structures, refuse disposal, water and sewer <br />DRAFT MINUTES <br />
