The east -west section of Old Birch Street will be designed, reconstructed and financed by <br />the developer. <br />The north -south section of Old Birch Street will be designed and reconstructed by the <br />City in conjunction with the by-pass lane on Birch Street. The City will finance this <br />section through the annual pavement management plan. <br />Future Fox Road and Public Utilities Connection <br />The City and developer will continue to work with the Comcast property owner to obtain <br />land or easement in order to extend Fox Road and public utilities to Foxborough. The <br />City Attorney has sent a letter to the property owner to help expedite the process. <br />This connection shall be required for Phase Two development. <br />Connection to Pheasant Run South -Preserve at Lino Lakes <br />Pheasant Run South will be extended west from the Preserve at Lino Lakes to Old Birch <br />Street in Phase One. <br />Trail Construction <br />The existing trail will be extended north from Foxborough to the Saddle Club property in <br />Phase One. The trail will make a full connection to Fox Road, Blackberry Court and the <br />Preserve at Lino Lakes in Phase II. <br />Floodplain <br />The 1982 FEMA Flood Insurance Rating Map (FIRM) indicates the northeast quadrant of <br />the site is located within a designated Zone A flood plain district. <br />A Conditional Letter of Map Revision (CLOMR) shall be obtained from the Federal <br />Emergency Management Agency (FEMA) prior to the construction of any public streets <br />and utilities. A Letter of Map Revision (LOMR) shall be obtained from FEMA prior to <br />issuance of any building permits for lots located within the floodplain. <br />Growth Management Policy <br />Per the Comprehensive Plan (page 3-27), an annual average of 230 units per year over <br />each 5 year phasing period not to exceed 345 units in any 1 year is allowed. At the end <br />of the 5 year phasing period unallocated units will be averaged out over the next 5 years. <br />Development Contract <br />A Development Contract shall be drafted by the City, executed by the City and the <br />developer and recorded by the developer. <br />5 <br />
