Planning & Zoning Board <br />January 8, 2003 <br />Page 14 <br />Mr. Pfingsten stated he could make this into a multi - million dollar business but he has no <br />desire for those kinds of headaches. He stated he has a profitable, manageable business <br />and that is what he wants. <br />Mr. Rafferty stated that his concern is with the growth in the number of vehicles. He <br />stated he sees no beauty in a five -foot fence that says "keep out" and Mr. Pfingsten may <br />have some suggestions as to how to plant the area to enhance the site including the <br />neighborhood. Mr. Pfingsten stated he would be happy to inform the residents of the type <br />of trees he would like to plant. Mr. Rafferty stated a diagrammed landscape plan would <br />be helpful as well as pictures. <br />Mr. Corson stated if this application is tabled, he would like to consider a <br />recommendation that it return as a conditional use permit and site plan review rather than <br />a rezoning. <br />Mr. Johnson asked how conditional use permits are enforced. Mr. Lyden stated they are <br />reviewed annually but if there are concerns there is no reason why it cannot be reviewed <br />more often than annually. That review is done by staff in conjunction with the City <br />Council. <br />Mr. Johnson asked if a conditional use permit has ever been revoked for violations. Chair <br />Schaps stated it probably has occurred and residents can come to the Board with such a <br />complaint about a violation. <br />Mr. Johnson stated the residents have called the City Hall with complaints before and <br />even though the staff agreed there was a violation, nothing changed. He stated that is all <br />that is done. <br />Mr. Smyser asked when Mr. Johnson called to complain about something. Mr. Johnson <br />stated he has called numerous times in the past several years. <br />Mr. Lyden made a MOTION to continue the public hearing to February 12, 2003 and <br />table consideration of the Rezoning and Comprehensive Plan Amendment requested by <br />Charlie Pfingsten, Charlie's Tree Service, 908 1/2 Maple Street, to encourage Mr. <br />Pfingsten and the residents to meet to discuss the issues, and that this application return <br />as a conditional use permit and site plan review. <br />Chair Schaps mentioned to Mr. Pfingsten that there is no sentiment for outdoor storage, <br />other than the one RV and one trailer, and no consideration as to any future expansions or <br />additional equipment stored outdoor. He stated Mr. Pfingsten will also have to address <br />the issues of noise and lights. <br />Chair Schaps stated this is an opportunity for the residents to make an agreement all can <br />live with, not to lay down unreasonable demands. <br />DRAFT MINUTES <br />• <br />• <br />• <br />
