He stated their <br />option allowed vehicles to go around the vehicle dropping people off. Mr. Smyser stated <br />staff was in total agreement with applicant's proposal. <br />Mr. Hayes stated there was already screening in place, which they did not realize. He <br />noted there were large 8 -9 pine trees and well as deciduous trees that were put in <br />approximately ten years ago. He requested they not be required to add additional <br />screening. He stated they had originally shown a sidewalk coming out of the sanctuary, <br />but he has discovered it is not something that was required by Code. He asked they not <br />be required to add this sidewalk. Mr. Smyser stated the City did not require a sidewalk. <br />Mr. Smyser suggested adding a Condition number 14 to staff's report indicating that the <br />tree issue would be looked at before this went to the City Council and recommendations <br />would be made to the City Council. <br />Mr. Lyden made a MOTION to close the public hearing at 9:05 p.m. The motion was <br />supported by Mr. Hyden. Motion carried 6 -0. <br />Ms. Lane made a MOTION to approve ATS &R, Living Waters Lutheran Church, 865 <br />Birch Street, Site Plan Review and Conditional Use Permit with the 14 recommendations <br />and conditions as outlined in staff's report. The motion was supported by Mr. Lyden. <br />Motion carried 6 -0. <br />D. PUBLIC HEARING, Bruggeman Properties, SE corner of Birch Street and <br />Hodgson Road, Preliminary Plat, Rezone, CUP, and Site Plan Review <br />Chair Schaps opened the Public Hearing at 9:08 p.m. <br />Staff stated Bruggeman Properties has requested preliminary plat approval to allow a <br />three lot, commercial subdivision on property located south of Birch Street and east of <br />Hodgson Road. <br />The development site overlays 33.3 acres of land, 24.8 acres of which is to be reserved <br />for future medium density development (to be developed after the present residential <br />development moratorium is lifted) and lies within the shoreland overlay district of <br />Baldwin Lake. <br />To accommodate the development proposal, the following approvals are necessary: <br />1. Rezoning of a portion of the property from R, Medium Density Residential to GB, <br />General Business /PDO (to allow private streets and multiple buildings on a single <br />lot) <br />2. Preliminary Plat <br />3. Site and Building Plan for a 12,160 square foot retail center <br />4.
