Planning & Zoning Board <br />February 12, 2003 <br />Page 4 <br />DRAFT MINUTES <br />• Minor maintenance and repairs to equipment permissible (oil changes, <br />washing, etc.) <br />• Will not park any equipment outside fenced area <br />• No wood piles or wood chips will ever be stored at this site <br />As background, and for comparison, staff attached the previous CUP for the site, which <br />also had a number of conditions. <br />Certificate of Occupancy <br />The parties seem to be in agreement on all of the above conditions, with the exception of <br />#7, which relates to the inspection of the soil, water, and septic system on the property. <br />This condition is written so as to be fulfilled by the current owner of the property, prior to <br />Mr. Pfingsten taking ownership. <br />In light of such issues, it is important to draw attention to Section 2, subdiv. 8 of the <br />City's zoning ordinance, which relates to Certificate of Occupancy. This subdivision <br />stipulates that any change of use (of land or structure) requires a C.O. It is through such a <br />process that the City verifies that property and structures are up to code. In the present <br />instance, the C.O. process can be used to verify septic conditions on site. <br />Applicants Intended Use <br />At the January meeting, Chair Schaps directed the applicant to address the following <br />specific issues: <br />• What vehicles are to be parked on the site, and where. <br />• If any repairs to vehicles are to take place on the site. <br />• Provide a complete Site Plan, noting where vehicles would be parked. <br />Mr. Pfinsten has drawn a site plan noting where the two items to be stored outside will be <br />parked (a 16 -foot Bobcat trailer & a Trailer used for field research). No repairs beyond <br />general maintenance (oil changes) are envisioned to take place on the property. Any <br />general maintenance procedures would take place inside the pole building. <br />Conditional Use Permit Proposal <br />At the January meeting Chair Schaps directed staff to find a way to cover Mr. Pfingsten's <br />proposed use through use of a Conditional Use Permit. Since the property is zoned <br />Rural, and the City's Zoning Ordinance does not currently allow any conditional use <br />similar to that which the applicant is proposing, the Zoning Ordinance must be amended <br />to achieve this objective. If amended, however, such a conditional use could then take <br />place on any property zoned Rural in the City. <br />To that end, language such as the following might be appropriate to add to Section 5, <br />subdiv. 1.H of the Zoning Ordinance (Rural Conditional Uses): <br />DRAFT MINUTES <br />• <br />• <br />
