Planning & Zoning Board <br />February 12, 2003 <br />Page 52 <br />DRAFT MINUTES <br />Page 6 -34 under conditional uses, clubs and lodges, Mr. Smyser suggested be deleted. <br />The Board agreed with the suggestion. <br />No changes were made to the R -6 District. The R -7 District was deleted. <br />Brick red would be added to the colors under the neighborhood business district. <br />Mr. Smyser asked if gas stations should be allowed in the business districts. He stated <br />the other committees agreed they should remain in the business districts. <br />Mr. Lyden stated no -- gas stations should not be allowed. He indicated the City did not <br />need this. Mr. Smyser stated they would remain in as a Conditional Use Permit as <br />written. <br />Ms. Lane asked if gas stations stayed in the Ordinance, did they have to approve the <br />development. Mr. Smyser replied as long as the development met the requirements, the <br />Board would have to approve the development. He noted they were tightening up the <br />requirements for gas stations. <br />Mr. Hyden stated he was concerned that the City would have 50 gas stations. He stated <br />the City had too many gas stations and banks. <br />Mr. Smyser replied they could not legally base any decision on how many people showed <br />up to oppose it, but they could oppose it by limiting the locations of the gas stations by <br />putting something in the Zoning Ordinance. <br />Chair Schaps noted the gas stations were already limited to basically four intersections in <br />the City. <br />Councilmember Carlson asked why couldn't they limit gas stations like they do liquor <br />stores, by saying they need to be so far apart. <br />Chair Schaps asked who wanted to eliminate gas stations. The Board recommended to <br />eliminate it out of the neighborhood business district. <br />Mr. Rafferty suggested limiting gas stations to the freeway accesses. Chair Schaps stated <br />if they wanted commercial development, whether they like it or not, it would need to <br />have a gas station with it to be successful. <br />Mr. Rafferty noted there were many business they could put in. Chair Schaps replied no <br />developer would be interested in developing if they could not ensure people would get <br />out of their car. He noted gasoline drives the leasing. He noted the only option they had <br />was to say where they did not want gas stations — not that they did not want them in the <br />City. <br />Mr. Rafferty stated he was in favor of eliminating gas stations from commercial sites and <br />limiting them to the freeway entrances. <br />DRAFT MINUTES <br />• <br />
