Rear -yard distances are based <br />on the limit of the Applicant's property, which extends well beyond the site of the <br />proposed use. Setbacks for additional uses to the north will need to be maintained <br />when that land is subdivided and developed. <br />The structure meets the setback requirements of a building of the height proposed with <br />the exception of the 22.5 -foot requirement added onto the setback from the arterial road, <br />due to the height of the building. The building infringes on the setback on the east due <br />to efforts by the Applicant to avoid a small wetland on the west side of the property. <br />Height Requirements <br />In the LI District, no building shall exceed forty -five (45) feet in height. The dome will <br />be 90 feet high at the center. Based on the proposed height, the structure will be <br />considered a conditional use. A conditional use for height in the City's Zoning Ordinance <br />prescribes a number of performance criteria related to shadows, buffers, setbacks and <br />landscaping that must be addressed.
