Construction Plans for Cedar Street West and 21st Avenue North - Utility and <br />Street Improvements <br />On June 19, 2003, the City sent a letter to Mr. Bill Fogarty of Fogarty Investments <br />indicating the Conditional Use Permit submitted was incomplete. The items needed to <br />make the application complete, with the exception of the traffic analysis, have now been <br />submitted. <br />ANALYSIS <br />Land Use and Zoning <br />Location <br />Guided Land Use <br />Existing Zoning <br />Site <br />Industrial <br />Light Industrial <br />West <br />Industrial - (Centerville) <br />Industrial (Centerville) <br />North <br />Industrial <br />Light Industrial <br />East <br />I -35E and Industrial <br />Light Industrial <br />South <br />Medium Density Residential <br />Rural <br />The land for which the Sportatorium is proposed is currently zoned Light Industrial. The <br />Light Industrial District allows as a permitted use "12. Recreational business contained <br />entirely within the principal building." The Sportatorium, which includes three ice sheets, <br />qualifies as a recreational business contained within the principal building. <br />The proposed use is unique in that it constitutes two separate but related uses, the ice <br />facility and the restaurant/banquet room/pro shop. Based on the City Zoning Ordinance, <br />these uses are conditional uses in the LI District: (Section 8, Subd.1.I (1)) "Accessory, <br />indoor retail, rental, or service activity other than that allowed as a permitted use or <br />conditional use within this section, provided that: (a) Such use is accessory and related to <br />the permitted industrial use allowed within the LI District; and (b) Such use does not <br />constitute more than thirty (30) percent of the gross floor area of the principal building." <br />The pro shop, restaurant and banquet area are all incidental to the ice arena, and these <br />uses together at 9,204 square feet are less than ten percent of the total floor area of the <br />facility (117,000 square feet). The restaurant, banquet room and pro shop qualify as <br />conditional uses to the principal use. <br />Most of the surrounding land uses are either industrial, medium density residential, or <br />rural. To the east is I -35E, a major transportation corridor, which runs north/south along <br />the property and serves as a buffer between the proposed use and land uses on the east <br />side of the freeway, which includes both industrial and residential. <br />12701 -002 <br />
