• <br />• <br />Bruggeman <br />page 13 <br />Specific conditions for commercial day care facilities: <br />a. All requirements of the Minnesota Department of Health and Human Services, as may be <br />amended, are satisfactorily met and the structure and operation is licensed accordingly. <br />Commercial daycare facilities must acquire licensing. <br />b. Screening is provided along all shared property lines. Such required fencing and screening <br />shall be in compliance with the applicable provisions of Section 3, Subd. 4.Q of this <br />Ordinance. <br />The landscaping plan should have additional screening. Staff will work with the <br />developer to address this. <br />c. Adequate off- street parking is provided in a location separated from any outdoor play area(s). <br />The plan includes the required number of parking stalls. They are on the north side of the <br />building and the play area is on the south side. <br />d. Adequate off - street loading spaces in compliance with Section 3, Subd. 6 of this Ordinance. <br />A separate loading area is not necessary for this building. <br />ENVIRONMENTAL BOARD <br />Board comments from January review of the original project submittal are attached. <br />Review of stormwater design is a vital aspect of development and is being handled by the <br />City Engineer. The project no longer includes a motor fuel station. <br />UNRESOLVED ISSUES TO BE ADDRESSED FURTHER <br />1. The reduction in setbacks and garage size is not sufficiently justified to fulfill the <br />purpose and intent of a PUD. In addition, a PUD requires 50% open space. <br />2. Exterior building materials: use of masonry and variety of materials on all sides. <br />3. Park dedication with credit for the private park area. The credit has yet to be <br />determined. <br />4. A signage plan for the commercial site should be supplied. <br />5. Lighting fixtures on the commercial site must be 90 degree cutoff design. <br />6. Screening of the commercial site should be increased. <br />OPTIONS <br />1. Approve rezoning of the residential area to R -3 Medium Density Residential, and the <br />commercial site to LB Limited Business. <br />2. Approve the preliminary plat/PUD plan. <br />
