D <br />STAFF ORIGINATOR: Jeff Smyser <br />P & Z MEETING DATE: January 14, 2004 <br />TOPIC: PUBLIC HEARING <br />Rezoning Site from R -4 to R -3 <br />Northeast Corner Lake Drive and Aqua Lane. <br />BACKGROUND <br />A recent development application has brought to light an inconsistency between the <br />comprehensive plan and the zoning on a property. When this occurs, the inconsistency must be <br />corrected. This rezoning was initiated by the City to address the inconsistency. <br />The subject site is four acres of property at the northeast corner of Lake Drive and Aqua Lane, <br />adjacent to the existing Marshan Lake Condominiums. The entire Marshan Lake Condominiums <br />site and the remaining four -acres along Lake Drive is guided Medium Density Residential. This <br />allows a density of 3 -6 units per acre. <br />The site is zoned R -4, a high- density zone. This is not consistent with the comprehensive plan's <br />Medium Density classification. To address this inconsistency, either the comprehensive plan or <br />the zoning should change. Based on the recommendation of the P & Z and the City Council <br />work session discussions, the site should be rezoned to R -3. Staff has prepared an amendment to <br />the zoning ordinance to rezone the site to R -3 to bring it into conformance with the <br />comprehensive plan. <br />ANALYSIS <br />The comprehensive plan was adopted by the City Council in August 2002. The plan includes a <br />land us map indicating proposed land uses. As indicated on the attached land use map, the site is <br />guided Medium Density Residential. As stated on page 86 in the comprehensive plan: <br />The City has defined density as follows: <br />Low <br />Medium <br />High <br />Town Center <br />= 1 to 3 units per acre <br />= 3 to 6 units per acre <br />= 6 to 12 units per acre <br />= 10 to 24 units per acre <br />Section 6 of the 2003 zoning ordinance describes the intended land use categories that each <br />• <br />residential zoning district should be in. The R -3 and R -4 zones are intended as follows: <br />
