Motion carried 4 -0. <br />Mr. Rafferty made a MOTION to recommend the allocation of 2.24 acres of MUSA <br />reserve, subject to the conditions as noted in staffs January 14, 2004 report and was <br />supported by Mr. Hyden. Motion carried 4 -0. <br />D. CONTINUED PUBLIC HEARING for Rezone and Preliminary Plat, Legacy <br />Holdings Lino Lakes LLC, Legacy at Woods Edge, SE corner of 35W and <br />Lake Drive <br />Staff stated they were continuing to work with the Hartford Group on the building <br />elevations and other issues raised in the December staff report. He noted staff would <br />present the revised plans to the Board for discussion at the January 28, 2004 Special <br />Planning & Zoning Board work session. <br />Staff recommended continuing the public hearing to the February 11, 2004 regular <br />Planning & Zoning Board meeting. <br />Mr. Tralle made a MOTION to continue the Public Hearing to the February 11, 2004 <br />regular Planning & Zoning Board meeting and was supported by Mr. Rafferty. Motion <br />carried 4 -0. <br />E. PUBLIC HEARING for Rezone, 4 -acre property at NE corner of Lake Drive <br />and Aqua Lane <br />Chair Schaps opened the public hearing at 9:35 p.m. <br />Staff stated a recent development application has brought to light an inconsistency <br />between the comprehensive plan and the zoning on the property. When this occurs, the <br />inconsistency must be corrected. This rezoning was initiated by the City to address the <br />inconsistency. <br />Staff noted the subject site is four acres of property at the northeast corner of Lake Drive <br />and Aqua Lane, adjacent to the existing Marshan Lake Condominiums. The entire <br />Marshan Lake Condominiums site and the remaining four -acres along Lake Drive is <br />guided Medium Density Residential. This allows a density of 3 -6 units per acre. <br />Staff stated the site is zoned R -4, a high - density zone. This is not consistent with the <br />comprehensive plan's Medium Density classification. To address this inconsistency, <br />either the comprehensive plan or the zoning should be changed. Based on the <br />recommendation of the P & Z and the City Council work session discussions, the site <br />should be rezoned to R -3. Staff has prepared an amendment to the zoning ordinance to <br />rezone the site to R -3 to bring it into conformance with the comprehensive plan. <br />Staff presented their analysis and recommended approving the rezoning from R -4 High <br />Density to R -3 Medium Density. <br />DRAFT MINUTES <br />
