A <br />STAFF ORIGINATOR: Jeff Smyser <br />P & Z MEETING DATE: March 10, 2004 <br />TOPIC: Resolution 03 -101: Final Plat, Century Farm North <br />BACKGROUND <br />The preliminary plat for Century Farm North was approved by the City Council on April <br />28, 2003. The approval includes a phasing plan as required by the growth management <br />ordinance. The final plat for phase 1 (56 units) was approved in July. The developer has <br />submitted the final plat for phase 2. <br />The submitted final plat includes individual lots for units in phase two of the approved <br />phasing plan. This includes 65 units: 22 single family detached townhomes, 42 single <br />family lots, and one single family lot for an existing house. This existing home was not <br />expected to remain when the phasing plan was approved. In order to comply with the <br />approved phasing plan, this lot must be counted as a new unit. <br />ANALYSIS <br />Because of the complexity of this project, each phase includes elements not necessarily <br />included in previous phases. The final plat for each phase must be compared against the <br />conditions of approval. <br />The final plat substantially conforms to the approved preliminary plat and phasing plan. <br />A revised title commitment is under review and must be approved by the City Attorney, <br />along with the association declarations, before the final plat is considered by the City <br />Council. The first phase's association document included the authority for the City to <br />enforce the terms of the declarations. The City Attorney recommends including this in <br />the second phase as well. <br />A development contract is being prepared, and will include financial securities. <br />Conditions attached to approval of the preliminary plat (Resolution 03 -60): <br />Condition #4: "The submitted townhome housing types and building elevations be <br />modified to specify finish materials and be subject to City approval. Side walls facing <br />public streets shall include windows or other architectural features to avoid the <br />appearance of a blank wall." <br />
