• <br />Fox Den Acres <br />page 5 <br />Existing City Easement: The project also proposes the partial vacation of an existing <br />ponding and flowage easement held by the City. This easement covers most of the land to the <br />east and south of the site, which comprises a large wetland area. The easement area to be <br />vacated is on Lots 3 -6, Block 4. The City looks carefully at requests to vacate such easements. <br />We require that the applicant prove that the easement is not necessary and that the vacation will <br />have no negative effect. If a revised project design incorporates more greenway preservation, <br />this easement vacation may not be necessary. <br />ENVIRONMENTAL BOARD <br />The Environmental Board reviewed this application on July 28. Recommendations are attached. <br />The recommendations include pursuing a conservation development, with design flexibility, to <br />facilitate a greenway corridor along the south and east sides of the site. <br />OPTIONS. <br />1. Approve the preliminary plat <br />• 2. Deny the preliminary plat. <br />3. Table the item. <br />RECOMMENDATION <br />Option 3, and the following issues must be addressed: <br />A conservation development approach that results in higher quality wetland areas and adequate <br />greenway buffers around them would be the preferred approach. This would be consistent with <br />the draft open space plan, the comprehensive plan, and the 1999 handbook for environmental <br />planning. If this is not going to happen, the project still must address the following: <br />Minimum lot areas must include contiguous land. <br />Easements around wetlands must extend ten feet beyond the delineated wetland. <br />House pads must not be in easements. <br />Stormwater ponds design and other engineering issues must be revisited. <br />• <br />
