• 2. Developer agrees to lay out, develop and maintain the Property as a car and <br />• <br />truck wholesale business. Said business shall be conducted as described in Exhibit B. No <br />changes or deviations shall be permitted unless authorized in writing by the City. <br />3. The Developer shall comply with all applicable rules, regulations, ordinances and <br />laws of the City of Lino Lakes, Anoka County, Rice Creek Watershed, State of Minnesota and any <br />other governmental agency having jurisdiction over the project. <br />4. Developer further agrees that in consideration of the City rezoning of and <br />conditional use permit for said property as described in paragraph 1 hereof, Developer is <br />forfeiting any rights and claims it has for non - conforming status of the contractor's yard activities, <br />including outdoor storage, conducted prior to the date of this contract. Such non - conforming <br />rights are forfeited even if the City commences an action, as provided herein, to rezone the <br />property back to LI Light Industrial from GB General Business. <br />5. In the event that Developer violates any of the covenants and agreements <br />contained in this zoning contract or any other additional agreements with the City or <br />governmental agencies, the City may commence an action to change the Property from the GB <br />General Business back to LI Light Industrial and the Developer will not object or oppose such <br />ordinance in any form. It is agreed by Developer that in the event of such zoning change, <br />Developer forfeits any claims of non - conforming rights to operate the car and truck wholesale <br />business and acknowledges that they will comply with all the allowable uses under the Light <br />Industrial classification in effect at the time of said rezoning. Furthermore, the City may, at its <br />option, refuse to issue building permits to the site and stop building construction within the site <br />until such time as such default has been corrected to the satisfaction of the City. Such actions <br />shall be in addition to any remedies the City may seek to enforce performance of this agreement <br />including but not limited to the right to seek injunctive relief. <br />6. The provisions of this Agreement shall be binding upon and enforceable against <br />Developer, their successors and assigns and all other subsequent owners of the Property, their <br />respective heirs, successors and assigns of the Property described in Exhibit A. <br />
