• <br />ZONING CONTRACT <br />This Agreement is made this day of , 2005, by and <br />between the City of Lino Lakes, 600 Town Center Parkway, Lino Lakes, Minnesota 55014, a <br />municipal corporation organized under the laws of the State of Minnesota, hereinafter referred to <br />as the "City," and Auto Brokers, Inc., 2851 - 84th Lane NE, Blaine, Minnesota 55449, a Minnesota <br />corporation, hereinafter referred to as the "Developer." <br />WHEREAS, Developer is the owner of certain Property in the City of Lino Lakes legally <br />described on Exhibit A attached hereto and made a part hereof; and <br />WHEREAS, the Developer has requested that the City change the zoning classification <br />for the Property from an LI, Light Industrial district to an GB General Business district; and <br />WHEREAS, it is believed by the City that the rezoning of said Property to a GB General <br />Business district so as to permit a car and truck wholesale business and eliminate the existing <br />outdoor contractor's sales yard would be in the public interest and welfare of the residents of the <br />City, and <br />WHEREAS, the Developer has agreed to develop the property solely as a car and truck <br />wholesale business in consideration of the City's changing the property to the GB General <br />Business district and the Developer further agrees as a part of said consideration to lay out, <br />develop and maintain the car and truck wholesale business as hereinafter set forth; <br />NOW, therefore, in consideration of the mutual promises of the parties made herein BY <br />AND BETWEEN THE PARTIES HERETO: <br />1. The City shall complete the procedures necessary under City Ordinances and <br />State Law to rezone the Property from LI Light Industrial to a GB General Business zoning district <br />under the City's Zoning Ordinance. The City also shall complete the procedures necessary <br />under City Ordinances and State Law to issue a conditional use permit for an outdoor sales lot <br />(not outdoor storage) in the GB zoning district under the City's Zoning Ordinance. <br />
