He noted this applied to staff, the P &Z Board and the City Council. He <br />strongly recommended against a recommendation that a committee be set up due to <br />administrative issues. <br />Mr. Laden suggested the developer invite members of the P &Z Board to the architectural <br />committee. Mr. Smyser replied this could be done, but he was not sure this was the <br />City's authority and legally, he believed they were "walking on thin ice" with this <br />suggestion and he was not comfortable recommending this. <br />Mr. Smyser stated they needed to decide if they wanted staff to review this, or if the P &Z <br />Board and the City Council review this. He stated it was not a good idea to only have the <br />P &Z Board review this because they were only a recommending body and the City <br />Council had the authority to approve or deny it. <br />Mr. Laden stated if this was an either or decision, then he trusted the staff to review it. <br />Mr. Bengtson added the following condition: 15. Each building site plan and elevation <br />shall be reviewed administratively by staff. <br />Mr. Hyden made a MOTION to recommend approval of a Conditional Use Permit for <br />Planned Unit Development, Development Stage Plan/Preliminary Plat, and Allocation of <br />Commercial MUSA for a five -lot commercial development named Apollo Landings, <br />Equinox Development LLP, 540 Lilac Street, subject to the 8 conditions as noted in <br />staff's April 13, 2005 report and the 7 conditions added at tonight's meeting and was <br />supported by Mr. Pogalz. Motion carried 5 -0. <br />Vice Chair Tralle recessed the meeting at 8:54 p.m. <br />Vice Chair Tralle turned the meeting over to Chair Rafferty. <br />Chair Rafferty reconvened the meeting at 9:07 p.m. <br />B. PUBLIC HEARING, for a Conditional Use Permit amendment to allow for an <br />awning at Rehbein Transit, 6298 Hodgson Road <br />Chair Rafferty opened the public hearing at 9:07 p.m. <br />Staff stated applicant had requested an 8 -foot x 100 -foot awning addition to the north side <br />of the existing facilities at 6298 Hodgson Road. The Rehbein property is covered by a <br />conditional use permit for the existing bus transit center. Building additions such as <br />those proposed in the application require an amendment to the Conditional Use Permit. <br />Construction of the addition was begun prior to the issuance of the appropriate building <br />permits or this application and was stopped by the City of Lino Lakes Building <br />Department. No further construction has taken place after the first warning was issued by <br />a building inspector. <br />DRAFT MINUTES <br />
