• <br />• <br />CITY OF LINO LAKES <br />ORDINANCE NO. 02 -05 <br />AN ORDINANCE AMENDING THE PLANNED DEVELOPMENT OVERLAY FOR <br />THE MARKETPLACE AS CREATED BY ORIDINANCE 16 -01. <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />SECTION I. FINDINGS <br />The City Council makes the following findings regarding the application for amending <br />the Planned Development Overlay for the property described below, based on the factors <br />listed in Section 2, Subd.lE of the Lino Lakes zoning ordinance: <br />1. The proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City <br />Comprehensive Plan, as the site is guided for commercial uses. <br />2. The proposed use is or will be compatible with present and future land uses of the <br />area. The site is guided for commercial uses. Land in the area of the site is <br />already developed with commercial uses or designated for such use. <br />3. The proposed use conforms with all performance standards contained herein. <br />4. The proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. Utilities are currently available to the site. <br />5. Traffic generation by the proposed use is within capabilities of streets serving the <br />property in conjunction with the public improvements proposed. <br />The Planned Development Overlay for the Marketplace as described in Exhibit A and as <br />approved by Ordinance 16 -01 is hereby amended as follows: <br />SECTION 2. DISTRICT PROVISIONS <br />A. Development of the subject property shall be in substantial conformance with the <br />preliminary development plans shown on the following exhibits: <br />Exhibit B Preliminary Plat prepared by Westwood Development Services dated <br />August 8, 2001. <br />Exhibit C Site Plan prepared by Parsons Transportation Group, Inc., dated August <br />20, 2001. <br />Exhibit D Grading, Drainage and Erosion Control Plan prepared by Parsons <br />Transportation Group, Inc., dated August 20, 2001. <br />
