• <br />AGENDA ITEM V.B.2 <br />STAFF ORIGINATOR: Paul Bengtson <br />MEETING DATE: October 12, 2005 <br />TOPIC: Public Hearing — Conditional Use Permit <br />Final Plan <br />Betty's Pies <br />Legacy at Woods Edge <br />BACKGROUND <br />The Hartford Group has applied for a Planned Unit Development final plan for a single tenant restaurant within <br />the Legacy at Wood's Edge project located on the southeast quadrant of Interstate 35W and Lake Drive. The <br />final plan consists of the building plans for the restaurant building as well as the final plat for the lot (Village <br />No. 4). <br />SBetty's Pies is a full service restaurant that meets the intent of the city's vision for a family oriented, <br />neighborhood gathering place in the new mixed use downtown. Owners Marti Sieber and Carl Ehlenz run the <br />Two Harbors, Minnesota, destination restaurant and this will be their first expansion into the metro area. <br />The overall area of the building will be 7,935 square feet. The majority of the building itself is single story, <br />with the exception of an office area which is located over the center section of the building. <br />The Planning and Zoning Board continued this item at the September 14th regular meeting, and offered up <br />comments to both staff and the developer about the proposal. Numerous revisions have been made to the plans <br />and are addressed throughout this report. <br />ANALYSIS <br />Governing Plans <br />This site is located within the Legacy at Woods Edge project and is therefore subject to the Lino Lakes Town <br />Center Design & Development Guide that was adopted by Ordinance 04 -04 as part of the original Planned Unit <br />Development for the site. <br />The layout generally follows the original Legacy at Wood's Edge layout, with the exception of the combination <br />of lots 3, 4, and 5 to create two lots. The main entry of the building will be from the parking lot, which is <br />•atypical for this type of urban development. However, the plaza that is being proposed in combination with the <br />outdoor dining area and the walkway from the street into the site has been determined to sufficiently act as an <br />
