The dining area is surfaced with concrete, bituminous or decorative pavers or may <br />consist of a deck with wood or other flooring material that provides a clean, <br />attractive, and functional surface. <br />h. A minimum width of thirty -six (36) inches shall be provided within aisles of the <br />outdoor dining area. <br />i. Storage of furniture shall not be permitted outdoors between November 1 and <br />March 31. Outdoor furniture that is immovable or permanently fixed or attached <br />to the sidewalk shall not be subject to the storage prohibition of this section. <br />However, any immovable or permanently fixed or attached furniture must be <br />approved as part of the administrative permit application. <br />Additional off - street parking shall be required pursuant to the requirements set <br />forth in Section 3, Subd. 5 of this Ordinance based on the additional seating area <br />provided by the outdoor dining area. <br />J. <br />k. Refuse containers are provided for self - service outdoor dining areas. Such <br />containers shall be placed in a manner which does not disrupt pedestrian <br />circulation, and must be designed to prevent spillage and blowing litter. <br />All these requirements have been met. The parking question has yet to be resolved <br />110 regarding the peak parking demand. <br />CONDITIONS OF APPROVAL <br />1. The lighting fixtures for the south wall must be 90 degree cutoff fixtures so they cast <br />light downward, not upward. New fixtures must be submitted prior to city council review <br />of the conditional use permit. <br />2. If parking, circulation, or traffic generation create problems in the future, the City <br />may require that additional parking be constructed, as shown on the plan as "proof of <br />parking ", which would require moving the trash enclosure. Additional requirements <br />may be imposed to resolve such issues. A performance or development agreement <br />shall be prepared, and recorded against the property, that requires the property owner <br />to install such parking as directed by the City. <br />3. Handicapped parking spaces must be provided to comply with applicable state law. <br />4. Water and sanitary sewer utilities must be constructed across this site in accordance <br />with the Millers Crossroads utility plan approval. An easement must be granted to <br />the City for these utilities. <br />• <br />
