Lighting structures for public hockey rinks not exceeding sixty (60) feet in height. <br />2. Conditional Use Permit. Building heights in excess of those standards contained in the <br />district provisions and any other sections of this Chapter may be allowed through a <br />conditional use permit, provided that: <br />a. Demonstrated need is established for the increase in height and said increase <br />will not violate the intent and character of the zoning district in which the structure <br />is located. <br />The applicant is proposing a building that will be 46 feet in height with 7 <br />feet of parapets extending above. That means an overall height of 53 feet. <br />Anyone building within the same district would be allowed a 45 foot <br />building with 4 feet of parapet or a 49 foot overall height. This means the <br />increase is only 3 feet overall or roughly an 8% increase. Considering that <br />the increased parapet height attempts to not only provide screening of <br />rooftop equipment but also add architectural detail; it is a rather minor <br />increase. If for example they followed the height guidelines and built a four <br />story structure with a 45 foot height, but had an elevator penthouse that <br />extended another 8 feet for an overall height of 55 feet, it would be allowed <br />by the ordinance. Therefore staff doesn't feel that this increase would <br />violate the intent and character of the GB (General Business) zoning <br />district. <br />b. The site is capable of accommodating the increased structure size. <br />The site appears to be capable of accommodating the increase in size, <br />since it will not cause an increase in the building footprint the only concern <br />in that regard would be the parking for the site. The revised shared parking <br />analysis is attached to this report and shows that with the slight revision to <br />the site plan to include more parking as part of this first phase of <br />development, the site will still function with a sizable surplus. <br />c. The potential increased intensity and size of use does not cause an increase in <br />traffic volumes beyond the capacity of the surrounding streets. <br />The current roadway and city utility systems will be adequate to serve the <br />additional rooms. <br />d. Public utilities and services are adequate. <br />
