For each additional story over the district limitation or for each additional ten (10) feet above the maximum allowed per district, front and side yard setback requirements shall be increased by ten (10) percent. The standard setback for the GB (General Business) zoning district is 30 feet and this project exceeds that by well over the 10% (3 feet) that this requirement ensures. f. The construction does not limit solar access to abutting and /or neighboring properties. A shadow study shall be required illustrating shadow encroachment on adjoining properties. g. • There has been no shadow study done because of how minor the encroachment would be at only 8% or 53 feet. The provisions of Section 2, Subd. 2. of this Ordinance are considered and satisfactorily met. Section 2, Subdivision 2 of the ordinance lists the following findings: a. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan. b. The proposed development application is compatible with present and future land uses of the area. c. The proposed development application conforms to performance standards herein and other applicable City Codes. d. Traffic generated by a proposed development application is within the capabilities of the City when: 1) If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade. 2) If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C. 3) If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D.
