He pointed out that they have included additional open space and landscaping with <br />this plan. <br />Mr. Root reiterated that this is an allowable use, and the board is not able to choose users. <br />He added that the building was approved and is established, and reiterated that the two <br />items for the CUP are the outdoor seating and drive - through. He noted that he likes the <br />outdoor seating and feels it is a good feature. He has concerns with the drive - through <br />including striping, the degree of the angle to exit, and generating car traffic <br />Mr. Root asked about the future parking area on the south side of the building. Mr. <br />Smyser stated that this parking area would be for employees only. <br />Mr. Root was concerned about the lighting and sound from the menu board. Mr. Smyser <br />pointed out that the nearest town home is almost three feet away, and that the speaker is <br />not large therefore should not be audible to the residential area. <br />Mr. Root asked if the board could separate the approvals for the outdoor seating and the <br />drive - through. Mr. Smyser replied that the board could separate the items. <br />Mr. Smyser noted that traffic was studied as part of the entire Miller's Crossroads project. <br />Mr. Tralle expressed concern that the drive - through would add traffic to the town homes. <br />Mr. Hilger pointed out that the original proposal for platting the site included four <br />buildings, which have been reduced to one building. He added that the County required a <br />right turn only onto Birch St., regardless of the user. He continued that a drive - through <br />has the same issues of access as other users, and that they are now proposing a fraction of <br />what they started with. <br />Mr. Hyden wondered if studies show that a drive - through increases business. Mr. Hilger <br />replied that studies done by ITE, International Traffic Institute, show no data on coffee <br />shops, only fast food facilities. He added that the studies show that the biggest <br />contribution a drive - through provides is a reduction on parking. <br />Mr. Hyden reiterated that the board will not determine what users can go into a space, <br />and they should focus on the two issues at hand. <br />Linda Fagerland, 181 Egret Lane, asked how the board could approve a coffee shop with <br />one across the street if the gas station was not approved because there was one across the <br />street. <br />Mr. Smyser replied that when Miller's Crossroads was originally considered, the zoning <br />was not yet determined. He explained that since zoning has now been determined for the <br />site, the city cannot refuse a use if it is allowed in that zone and meets requirements. He <br />continued that the city has no legal right to refuse a coffee shop. He added that they have <br />no data to indicate that a drive - through will increase traffic. <br />DRAFT MINUTES <br />
