Planning & Zoning Board <br />April 12, 2006 <br />Page 2 <br />A. CONTINUED PUBLIC HEARING for a Conditional Use Permit to allow a <br />commercial dog kennel at 7933 -24th Avenue <br />Mr. Bengtson presented the staff report. <br />Staff recommended approval subject to the five conditions listed in the staff report. <br />Chair Rafferty declared the continued Public Hearing open at 6:38 p.m. <br />Board members expressed concern for current unsanitary conditions of the site along with <br />runs that do not meet standards. Board members agreed that at this time, the site is not <br />compliant with the regulations for a kennel license. City Staff reminded the board that <br />they are voting on a conditional use permit for the property, not a kennel license. <br />Mr. Bengtson reported that the police department will inspect the site for compliance <br />with the ordinance in regards to a kennel license. Mr. Bengtson confirmed that the city <br />could revoke the conditional use permit if a violation of Section 502 of the City Code <br />occurs. <br />Board members were concerned with the issuance of a commercial use versus a private <br />use, noting that a commercial use is intended for the sale of dogs. Mr. Bengtson noted <br />that the standards for a private or commercial kennel are the same, but a maximum of <br />four dogs are allowed with a private kennel. <br />Board members agreed that the animal ordinance should be revised, stating that it lacks <br />standards that should be in place for the protection of dogs. <br />Mr. Bengtson clarified that the applicant has submitted a separate application for a <br />commercial kennel license and that the Police Department would have to inspect the site <br />for licensing. <br />Mr. Rafferty invited the public to speak. No one was present to speak on the subject. <br />The applicant was not present. <br />Mr. Tralle made a motion to close the Public Hearing at 7:13 p.m. and was supported by <br />Nelson. Motion carried 6 -0. <br />Mr. Rafferty pointed out a discrepancy regarding the number of allowable dogs referred <br />to in the applicant's letter. Mr. Bengtson stated that he could clarify the number being <br />requested with the applicant. He added that he understands the applicant is trying to <br />comply in order to keep all of her dogs, and a private kennel allows a maximum of four <br />dogs. Mr. Bengtson stated that according to the applicant, the sixth dog mentioned in the <br />letter belonged to a relative. <br />• Mr. Pogalz pointed out that a commercial kennel would allow for a dog to have puppies, <br />but they must be gone by six months of age. <br />DRAFT MINUTES <br />
