Deny rezoning, preliminary plat, and MUSA allocation. <br />• <br />• <br />RECOMMENDATION <br />Option 2 <br />Staff recommends denial of the rezoning, preliminary plat, and MUSA application based <br />on the following findings: <br />1. The City's comprehensive plan includes the following policies: <br />Plan transportation facilities to function in a manner compatible with <br />adjacent land use. (page 35) <br />Minimize and limit vehicular access onto all major collector and arterial <br />streets ensuring adequate distance between intersections and utilization of <br />appropriate traffic control methods and devices. (page 36) <br />Land uses in the area need good, safe access to arterial roads. Because of the <br />short distance between Hodgson and Ware Roads, access management is vitally <br />important. One access to CR J, a public street, will provide good access to all <br />properties adjacent to the subject site, and to the site itself. The proposed project <br />does not provide for such a street. <br />2. The City's Growth Management Policy, Ordinance No. 24 -04, includes a finding <br />that "managing growth through the orderly provision of infrastructure and other <br />means promotes the goals and policies of the comprehensive plan." <br />3. The City's Growth Management Policy states that "promoting development <br />within the existing MUSA is preferable to expanding the developing area of the <br />City by granting MUSA reserve acres." <br />4. The proposed project requires approval of a rezoning, preliminary plat, and <br />allocation of MUSA reserve. The site currently is not within the MUSA. <br />5. The City is conducting a planning study for an area that includes the proposed <br />development site. This study will determine how the City will plan for <br />infrastructure to serve the area. This includes transportation, water, and sanitary <br />sewer. The study also will determine future land uses for the area. <br />6. A local street or frontage road are possibilities for creating access to this site. <br />Section 1007 -4.7 of the subdivision ordinance requires that these possibilities be <br />used rather than an individual driveway. <br />
